Brian Schmitt
Mr. Schmitt joined Hake & Schmitt in 2010, became a partner in 2012, and became president of the firm in 2018. He is a leading scholar on J-1 waivers, especially in the difficult area of program, policy, and foreign relations issues in J-1 waiver cases involving U.S. Government funding, such as Fulbright cases.
He graduated from the University of Detroit Mercy School of Law in May 2008, with a book award for outstanding work for the Immigration Law Clinic. He has Bachelor of Science in biology with a concentration in molecular genetics from The Ohio State University, Columbus, Ohio (2002).
A Lieutenant Colonel in the U.S. Army JAG Reserves, Mr. Schmitt attended the Judge Advocate General’s Legal Center and School in Charlottesville, Virginia, completing a Judge Advocate Officer Basic Course in February 2010 and the Judge Advocate Officer Advance Course in December 2015.
He has been a volunteer member of the National Ski Patrol since 1995.

A comprehensive review of all USCIS Administrative Appeals Office (USCIS AAO) decisions from 2007 to the summer of 2022, with Aaron Pentheny. Concludes that between 2018 and 2020, hardship waiver appellants experienced a hostile adjudications climate at the AAO. This paper provides a useful tool in predicting the likelihood of success in I-612 hardship waiver applications that do not include U.S. Government funding.
